Hurt in Palmetto Bay or Pinecrest
Most people who contact a lawyer after an accident in south Miami-Dade are not looking for a legal lecture. They want to know whether to see a doctor again, whether the other driver's insurer can be trusted, how long they have, and what happens to the bills in the meantime. This page tries to answer those questions for two villages on the south side of the county, Palmetto Bay and Pinecrest, using the roads, hospitals, and courthouse that people there actually deal with.

Two villages, one main road
Palmetto Bay and Pinecrest are villages, not large cities. Pinecrest was incorporated on March 12, 1996, and Palmetto Bay on September 10, 2002. Each has its own village government, which matters in one specific situation: if you are hurt on village property, special rules apply, described in the Pinecrest section. Around them is more of the county's unincorporated area and other municipalities, so the name on a mailbox does not always tell you who maintains the road where a crash happened.
US-1 runs through both villages and carries most of the through-traffic. According to the Florida Department of Transportation's 2025 traffic counts, the stretch of US-1 between SW 112th and SW 98th Streets in Pinecrest carries about 82,500 vehicles a day, and the stretch ending at SW 136th Street in Palmetto Bay about 57,500. Old Cutler Road, Coral Reef Drive, and SW 57th Avenue (Red Road) carry far less, roughly 13,000 to 19,000 vehicles a day, but they meet US-1 and each other at signals and turn lanes, and that is where many local crashes begin.
What the crash numbers do and do not show
Miami-Dade's public dataset of killed-or-seriously-injured (KSI) crashes lets us count serious crashes by city. For crash years 2019 through 2024, our own count, using the dataset's city field, finds 59 such crashes in Palmetto Bay and 36 in Pinecrest. Those are small numbers next to the county's largest cities, and they describe serious crashes only, not fender-benders or lesser injuries. We have not compared them to individual police reports, so please read them as a rough local picture. Read them as a rough local picture and not as a ranking of how safe either village is: the counts cover six years, the villages are small, and one multi-vehicle crash can add several entries.
Cyclists and pedestrians
People in south Miami-Dade walk and ride bicycles as well as drive, and the law protects them too. Florida law, in section 316.083, requires a driver who overtakes a bicycle in the same travel lane to pass at a safe distance of not less than 3 feet, or to stay behind the rider until a safe pass is possible. The same distance rule applies when the bicycle is in a bike lane, but not when it is in a separated bike lane. If a driver passed too close, turned across a rider, or opened a door into a lane, the details of the road, the lane markings, and the lighting all become evidence. Photographs of the exact spot, taken in daylight if the crash happened at night, can help.
For pedestrians, what matters is where they were crossing, what the signal showed, and what the driver could see. Witnesses are often neighbors or other drivers, and they are easiest to find in the first hours. Keep any helmet, clothing, phone, or bike damaged in the crash, and do not repair or discard them until you have talked with a lawyer.
Where serious injuries are treated
Florida's Department of Health maintains a list of verified trauma centers, last updated July 23, 2026. In Miami-Dade it names HCA Florida Kendall Hospital and Jackson Memorial Hospital as Level I, and HCA Florida Aventura Hospital and Jackson South Medical Center as Level II. Jackson South, at 9333 SW 152nd Street, houses the Ryder Trauma Center | Jackson South. Emergency crews choose the destination based on the patient's condition, so we do not say which hospital is closest to you. What matters for a claim is that you are seen promptly and that every symptom reaches the chart.
Where a lawsuit would be filed
The 11th Judicial Circuit has a South Dade Justice Center at 10710 SW 211th Street, Miami 33189. The Miami-Dade Clerk says circuit civil cases may be filed at the Soto Justice Center downtown or at district court locations. Under Florida's venue statute, section 47.011, a civil action is brought in the county where the defendant lives, where the claim arose, or where the property in dispute sits. For a crash in Palmetto Bay or Pinecrest, that usually means Miami-Dade County. Which building a given case is filed in depends on its type and size, and we take care of that.
Insurance, medical bills, and the first weeks
The first insurance question after a car crash is usually no-fault, and the clock starts on the day of the crash. Florida's personal injury protection (PIP) rules generally require that you get initial treatment within 14 days. The full $10,000 in medical benefits is available only if a physician, dentist, physician assistant, or advanced practice nurse determines that you have an emergency medical condition; otherwise PIP medical benefits are limited to $2,500. Miss the 14-day window and you can lose PIP benefits, so go even if you feel "mostly fine." Our PIP guide has the details.
PIP is capped and does not pay for everything, so a serious injury often leads to a claim against the at-fault driver's liability coverage, your own uninsured motorist coverage, or both. Bring your own policy to the first call so we can see what coverage you carry. That claim is subject to Florida's comparative-fault bar: under Fla. Stat. 768.81(6), a person found more than 50% at fault for their own harm cannot recover damages. For negligence claims that accrued on or after March 24, 2023, the general deadline to file suit is two years. Florida also requires a crash report when there is an injury, a death, or apparent property damage of at least $2,000, so ask for the report number.

Keeping a simple record
A claim is easier to explain when the story is written down while it is fresh. Start a note on your phone or a notebook the day of the crash. Record the date, time, and place, what you were doing, what you remember about the other vehicle or person, and the names and numbers of anyone who saw it. Then keep adding to it: each doctor visit, each symptom that changes, each day you could not work or drive, and each bill or receipt. Insurers often ask months later for details people no longer remember, and a note made at the time can help fill the gaps. Save texts and emails with adjusters, and do not post about the crash or your injuries on social media.

Palmetto Bay
Palmetto Bay is a village of more than 24,000 residents on the shore of Biscayne Bay, incorporated on September 10, 2002.
Car accidents in Palmetto Bay
FDOT's 2025 counts show US-1 at about 57,500 vehicles a day on the stretch ending at SW 136th Street, with trucks at 5.5%, about 3,160 a day. Old Cutler Road between SW 152nd and SW 136th Streets carries about 18,800 vehicles a day, Coral Reef Drive about 13,200, and SW 168th Street about 11,700. The busiest road and the quieter ones meet at signals and turn lanes, which is where many serious crashes happen. In that count, intersections stand out, so the signal, the turn lane, and the lines of sight are often the heart of the dispute.
Our own count of the county's public killed-or-seriously-injured dataset, using its city field for crash years 2019 through 2024, finds 59 such crashes in Palmetto Bay, 6 of them fatal. Of the 59, 28 were coded as intersection-related, 10 involved a motorcycle, 7 a bicyclist, and 6 a pedestrian. The most common types were right-angle crashes (12) and rear-end crashes (10). That is our tally of serious crashes, not an official village statistic and not a count of every collision.
If you were hurt, the first record is the crash report. Ask for the number, then add your own: photos of both vehicles, the intersection, skid marks, and traffic signals. If a driver ran a signal or turned across your path, write down which direction each vehicle was heading. When two drivers each say they had the green light, independent witnesses and any camera footage from nearby businesses or homes can decide the case, so ask neighbors and shops early. Slip and falls in Palmetto Bay
A fall in a store, restaurant, or shopping center is a premises liability claim. Under Fla. Stat. 768.0755, when the hazard is a transitory substance such as a spill, you must show the business knew about it or should have known. If you fell on village-owned property, Fla. Stat. 768.28 generally requires written notice within three years and suit within four, with caps of $200,000 per person and $300,000 per incident. Jackson South Medical Center, at 9333 SW 152nd Street, is on the state's Level II trauma list for serious injuries. A fall in a parking lot or on an uneven walkway raises a different question, which is who maintained the surface, and photographs taken the same day help answer it. Car accidents in Pinecrest
US-1 is the main road. FDOT's 2025 counts put it at about 55,500 vehicles a day between SW 136th and SW 112th Streets, with trucks at 3.4%, and about 82,500 between SW 112th and SW 98th Streets, with trucks at 3.6%, roughly 2,970 a day. Old Cutler Road carries about 19,100 and SW 57th Avenue (Red Road) about 13,100. Drivers cross US-1 or turn onto it from side streets and driveways, and on a road with several lanes in each direction, a lane change or a left turn can involve three or four vehicles at once.
Our own count of Miami-Dade's public killed-or-seriously-injured dataset for 2019 through 2024 finds 36 such crashes in Pinecrest, 8 of them fatal. Eleven involved a pedestrian, 3 a motorcycle, and 2 a bicyclist. The most common crash type was pedestrian (10), followed by rear-end (7) and head-on (5). It is a tally of serious crashes only, and it is ours, not the village's. Pedestrians were involved in 11 of the 36, about three in ten. A pedestrian-involved crash depends on where the person was crossing, the signal, and what the driver could see, so note those details while you still remember them. In a multi-vehicle crash on US-1, fault can be spread among several drivers, and because Florida bars recovery for anyone found more than 50% at fault, how each driver's part is described early on can matter. Photographs of vehicle positions, lane markings, and the road surface are worth taking before traffic clears. Slip and falls in Pinecrest
Pinecrest Gardens, a 14-acre botanical garden at 11000 Red Road, is managed by the Village of Pinecrest. A fall there, or on any village sidewalk or building, is a claim against a government body, and the notice rules in Fla. Stat. 768.28 apply: written notice generally within three years, suit within four, and caps of $200,000 per person and $300,000 per incident. Notice requirements are strict and the process differs from a private store claim, so contact us early. For falls in private businesses, Fla. Stat. 768.0755 applies to spills. Pinecrest Gardens was formerly Parrot Jungle, and the village's history page notes that the property was added to the National Register of Historic Places in 2011, so if you fell there, photograph the exact spot, the surface, and any warning signs, and ask for the incident report. I was hit while cycling on US-1 or Old Cutler Road. What matters?
Florida requires a driver passing a bicycle in the same lane to leave at least 3 feet, or wait until it is safe to do so (Fla. Stat. 316.083). Whether PIP applies to you depends on your situation and the policies involved. Get medical care, keep your bike and gear, photograph the road, and call us.
