Passengers, other drivers, and pedestrians

You may have been a passenger in the Uber or Lyft, the driver of the other car, a pedestrian, or a cyclist. Who you can claim against depends on who caused the crash and which insurance was in force. Rideshare companies carry separate coverage that may apply depending on whether the driver was waiting for a request, en route to you, or on a trip. We look at the app records and the police report before anyone guesses.

Get medical care first. Ask for the crash report number. Do not give a recorded statement to the other driver’s insurer, or to a rideshare claims adjuster, before you talk with a lawyer. Florida PIP generally requires initial treatment within 14 days if you want those benefits. Most injury lawsuits now have to be filed within two years.
