Brickell is a neighborhood of the City of Miami, and its injury claims look different from those in the suburbs. Pedestrians, scooter riders, rideshare passengers, and garage traffic are all part of everyday movement, and a fall can happen inside a building run by an association or management company rather than by a single owner. This page explains how Florida law handles car accidents, slip and falls, and truck accidents in a setting like this, using public sources for the local details.

Car accidents in Brickell

Brickell Avenue is part of US-1 (SR 5), and FDOT's 2025 counts show the traffic it carries along its length. The count is about 33,500 vehicles a day on the segment leading to SE 2nd Avenue, about 22,000 between SE 2nd Avenue and SE 2nd Street, and about 34,000 on the segment north of SE 2nd Street. On a city street with crosswalks, turning vehicles, and building driveways, a claim often turns on who yielded to whom.

County data shows that serious crashes in the immediate Brickell area are fewer than on the large suburban corridors. In the county's public Vision Zero crash dataset for 2019 through 2024, we counted 38 killed-or-seriously-injured (KSI) crashes inside a rectangle that covers the Brickell neighborhood layers on the City of Miami's address maps; 9 involved a pedestrian, 7 a bicyclist, 7 a motorcycle, and 7 included a death. That count is our own, built from the county's coordinates, so it is an approximation of the area rather than an official neighborhood figure. For the City of Miami as a whole, NBC 6 reported 257 KSI crashes in 2023, citing county data.

If you were hurt, here is what the law says about the first weeks. Florida PIP medical benefits require initial services within 14 days. Up to $10,000 applies when a physician, dentist, physician assistant, or advanced practice nurse determines you had an emergency medical condition; otherwise PIP is limited to $2,500. Crash reports are required when there is injury, death, or apparent property damage of at least $2,000. A person who is found more than 50% at fault for their own harm cannot recover damages (Fla. Stat. 768.81(6)).

Three situations come up often near Brickell:

  • Pedestrian and scooter crashes. If a vehicle turned across a crosswalk, a driver's own account is often the only version unless there is video. Nearby buildings and businesses may have cameras, and those recordings may be kept for only a limited time.
  • Rideshare passengers. More than one insurance policy can be involved. See our rideshare accident page.
  • Garage and valet incidents. These are often premises claims as much as driving claims.

For negligence claims accruing on or after March 24, 2023, the general deadline to file suit is two years.

Slip and falls in Brickell buildings

The question in a building fall is usually: who was responsible for that floor, stair, or walkway? In a condominium, Fla. Stat. 718.113(1) provides that the maintenance, repair, and replacement of the common elements is the responsibility of the association, except for limited common elements assigned to a unit owner by the declaration or the statute. A fall in a lobby, hallway, elevator, garage, or pool deck is therefore often a claim against the association, and sometimes also a management company or a cleaning or repair contractor. A fall inside a unit, on a balcony assigned to the owner, or on the sidewalk outside may involve different people, so the declaration and the facts matter.

Where the cause is a transitory foreign substance in a business, such as a spill at a restaurant or a wet entry at a retail shop, Fla. Stat. 768.0755 requires proof of actual or constructive knowledge of the condition. Constructive knowledge can be supported by circumstantial evidence that the condition existed long enough that the business should have discovered it, or that it occurred regularly. Rain tracked into a lobby is a familiar example, and evidence such as mat placement, mopping logs, and security video can show what the building did.

Because many buildings have front desks and cameras, a written preservation request should go out quickly. Ask for the incident report, and photograph the area the same day.

For emergency care, the Florida Department of Health's trauma center list (updated July 23, 2026) shows Jackson Memorial Hospital as a Level I trauma center. Jackson Health lists the hospital at 1611 NW 12th Avenue and the Ryder Trauma Center at 1800 NW 10th Avenue, each open 24 hours. A trauma designation describes what a hospital is equipped to treat; it is not part of how fault is decided.

If a case is filed, the Miami-Dade Clerk states that circuit civil cases may be filed at the Osvaldo N. Soto Miami-Dade Justice Center, 20 NW 1st Avenue, or at district court locations. The Soto Justice Center is in downtown Miami, not in Brickell. Not every claim requires a lawsuit.

Truck accidents in Brickell

Large trucks are a smaller share of traffic on most of Brickell Avenue than on some of the county's freight roads. FDOT's 2025 count shows trucks at about 8.1% of the 26,000 vehicles a day on the Brickell Avenue segment that begins at SE 12th Terrace, about 2,100 a day, and between 2.8% and 4.9% on the segments counted farther north. In the county's 2019 to 2024 crash data, 1 of the 38 serious crashes we counted in the Brickell rectangle was flagged as commercial-vehicle related, as were 74 of the 1,546 serious crashes in the City of Miami as a whole.

The PortMiami Tunnel is relevant context. A study published in the ITE Journal in November 2016 found that downtown Miami saw a decline in truck traffic from 2013 to 2015 after the tunnel opened in 2014, while nearby interstates saw an increase. Trucks that do reach Brickell can include deliveries, trash and recycling pickups, contractors, and moving vehicles serving buildings. When a collision with one of these happens, the same evidence rules apply as with a tractor-trailer.

Important rules: under federal hours-of-service regulations (49 CFR 395.3), a property-carrying driver generally may drive 11 hours after 10 consecutive hours off duty, may not drive after the 14th consecutive hour after coming on duty, and must have a 30-minute interruption after 8 hours of driving, subject to exceptions. Many short-haul delivery drivers fall under exceptions, so the first task is confirming which rules apply. Carriers must keep records of duty status and supporting documents for at least six months. Florida law also sets minimum liability coverage by weight, from $50,000 for 26,000 to under 35,000 pounds to $300,000 at 44,000 pounds and above, along with federal minimums.

What helps in a truck claim near Brickell: the company name on the vehicle, the plate or DOT number, photographs, any building or business video, and the driver's route and delivery records.
