Roadside work puts people close to moving traffic. When a driver fails to see that work zone in time, the harm can be permanent.

In a recent matter, our client was performing roadside work when another driver struck the client from behind. The collision was fatal. The at-fault driver carried limited insurance. Uninsured / underinsured motorist (UM/UIM) coverage applied, and the full coverage available was pursued. When the at-fault driver does not carry enough insurance

In many Florida injury and wrongful death claims, the driver who caused the crash does not have enough liability insurance to cover the loss. That is where UM/UIM coverage can matter.

UM/UIM is coverage the injured person (or the deceased person’s policy) may carry for situations where the at-fault driver is uninsured or underinsured. It is not automatic in every policy, and the available limits, stacking, and exclusions depend on how the policy was written and what the facts support. Roadside and work-zone crashes often involve commercial traffic, limited liability limits, and serious harm — so the insurance picture needs careful review, not assumptions.
